STEP 2:

Politicians and their aides call it opposition research. Lawyers call it discovery. They’re both talking about the same thing and that thing is, simply, information. In Step 2 of your Offer In Compromise you will watch as we focus on Congress’s attempt to give taxpayers open access to their records. In order to accomplish this, Congress passed a law you probably already know about, the Freedom of Information Act (FOIA).

The FOIA allows citizens to access all the information about them in the files of U.S. government agencies, including the IRS. This means that, with certain exceptions, any and all correspondence, reports, files, internal memos, videos, recordings, or other media that contain information about you is available for your review upon your request. It can take 5-10 months to get a response back from the IRS about your Offer In Compromise. So it is of utmost importance that you let us begin this process for you as early as possible so the IRS has adequate time to act on your request before we submit your Offer In Compromise.

Along with the FOIA request I also file Form 2848-Power Of Attorney. This enables me to get a copy of your tax account transcript so I can see whether the IRS made any errors in the handling of you account. During this time I also am researching on the the world’s largest tax-lawyer database of information, the cases, statutes and regulations. Part of my focus is to make certain there are no questions about whether you are in fact even liable for the taxes. If there is a chance you are not legally liable I will challenge the IRS on that basis. If the chance is very slight, then at the least this makes for a lower Offer In Compromise. At the same time, I also check for special circumstances and collection statutes that might stop the IRS from proceeding against you because too much time has run. I will then discuss my findings with you. Your Offer In Compromise now moves into Step 3.
